Owners attending Trustee meetings

One of the owners wants to attend the next Trustee meeting but the Chairperson that knows about these things say that owners can only attend Trustee meetings on invitation. What do we do in this case?

There are a number of people that are allowed to attend and speak at Trustee meetings:

  • Members
  • Registered bondholders
  • Section 25 right holders
  • The Managing Agent

History:
In previous years there were some controversial changes to this part of the Act.  In 1997 the PMR was added to state that owners can attend and speak at any meeting of the Trustees, but that they will not be entitled to vote.  In 2015 it was amended to state that they can only attend on invitation and could not speak at the meeting.

With the new STSM Act they may attend and speak again, but still cannot vote and now since 7 October 2016 they are not entitled to propose any motions for discussion and are not entitled to attend certain parts of the meeting where there are:

  • Discussions of contraventions of the Act or rules
  • Any matters where the Trustees feel that their presence will unreasonably interfere with the interests of the BC or any person’s privacy
Quote from the STSM Act: PMR 11(3) Members, registered bondholders, holders of future development rights and the managing agent may attend trustee meetings and may speak on any matter on the agenda, but they are not entitled to propose any motion or to vote; provided that such persons are not entitled to attend those parts of trustee meetings that deal with
  1. discussions of contraventions of the Act or rules; or
  2. any other matters in respect of which the trustees resolve that the presence of any such persons would unreasonably interfere with the interests of the body corporate or any person’s privacy.
