At one of our schemes, one owner signed the petition to call for a Special General Meeting on behalf of several owners stating that they had given him their proxy. Is this acceptable?
The reference to a proxy here refers to a meeting of the Body Corporate. In other words, you can only give me your proxy to attend the meeting on your behalf. The term “Proxy” in the STSM Act does not relate to you signing documents on my behalf. Should the person want to sign a document on behalf of an owner he/she would need to receive a Power of Attorney from that owner and not just a proxy.
Quote from the STSM Act:
Section 6
(5) A member may be represented in person or by proxy at such meeting: Provided that a person must not act as a proxy for more than two members.
