Is it a legal requirement for a Body Corporate to have disabled parking available?
There is nothing in the STSM Act regarding disabled parking bays. Should the Body Corporate decide to add such parking bays it will have to be done as an improvement to the common property – we have a separate Question of the week on how to do improvements to the common property.
It is however included in the National Building Regulations that should there be 50 or more parking bays there must be disabled parking made available as well. The bays should be located within 50 meters from the entrance of the buildings and should be clearly demarcated as parking for people with disabilities only.
